LURHQ Expert Testimony Leads To Preliminary Injunction In Ftc Can-Spam Case Against Phoenix-Avatar LLC
CHICAGO, Sept. 30, 2004—LURHQ, the leader in Managed Security Services for security professionals, today announced that one of its information security experts (identity withheld for privacy) provided expert testimony in a hearing that led to a preliminary injunction in the matter of the Federal Trade Commission v. Phoenix Avatar LLC. The case is one of the government’s first civil actions under the newly enacted CAN-SPAM Act.
Senators Conrad R. Burns (R-MT) and Ron Wyden (D-OR) introduced the CAN-SPAM Act in April 2003. CAN-SPAM was approved by the Senate in November 2003, the House of Representatives in December 2003, and was signed into law by President Bush on December 16, 2003.
LURHQ’s expert rebuttal witness testimony was crucial to clarifying and highlighting the realities of spam in today’s information age. LURHQ testimony pointed out glaring omissions in defense expert testimony and educated the Court on the ability to launder e-mail through open proxies.
